If you have purchased or are planning to purchase a tour with VIOLA travel s.r.o., we would like to inform you here about how we process your personal data in the context of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27. April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), often referred to by the abbreviation GDPR (General Data Protection Regulation).

3. Who is the data protection officer of VIOLA travel s.r.o.?

VIOLA travel s.r.o. is not obliged to appoint a data protection officer and therefore does not currently have a data protection officer.

4. For what reason does VIOLA travel s.r.o. process personal data of customers and website users?

VIOLA travel s.r.o. processes the personal data of customers in order to fulfil its obligations under the concluded travel contract, if applicable. on the grounds that it is required to do so by law or regulation.

VIOLA travel s.r.o. also sends commercial communications to customers. This processing of personal data is carried out on the basis of its legitimate interest within the meaning of Act No. 480/2004 Coll., on certain information society services. If the customer has agreed to this in the travel contract, VIOLA travel s.r.o. takes and publishes photographs of the customer in its promotional materials.

The VIOLA travel s.r.o. website uses cookies to function. Users can set their browser settings to store cookies on their device. This setting is considered consent to the processing of personal data. The browser is thus a tool for mediating consent.

5. Does VIOLA travel s.r.o. transfer personal data to other entities?

Yes, VIOLA travel s.r.o. transfers customers’ personal data to other entities.

VIOLA travel s.r.o. transmits customer data for the purpose of fulfilling the tour contract:

  • air carriers;
  • hotels;
  • business partners in the destinations;
  • to the delegates;
  • sales representatives.

By law, VIOLA travel s.r.o. transmits customer data:

  • the insurance company with which VIOLA travel s.r.o. is insured against bankruptcy.

On the basis of legitimate interest, VIOLA travel s.r.o. transfers customer data:

  • companies that VIOLA travel s.r.o. provide IT services, e.g. email service providers.

Based on the consent, VIOLA travel s.r.o. transfers the data of the website users:

  • Google LLC and Seznam.cz, a.s., providers of online advertising services, which process them on the basis of automatic processing for the purpose of personalising advertisements (so-called remarketing and retargeting).

6. Does VIOLA travel s.r.o. transfer personal data to third countries, i.e. outside EU countries?

Yes, VIOLA travel s.r.o. transfers personal data of customers and website users to third countries.

VIOLA travel s.r.o. transfers the personal data of customers to the extent necessary to a third country (hotels, air carriers, delegates) if at least part of the tour takes place in that country. The transfer in this case is based on Article 49(1) of the EC Treaty. 1 lit. (b) GDPR, i.e. handover is necessary for the fulfilment of the tour contract.

VIOLA travel s.r.o. transfers personal data via Google LLC to countries outside the EU, in particular. to the USA. The data are transmitted on the basis of:

  • the existence of a European Commission decision on adequate protection of personal data
  • appropriate safeguards, which are enshrined in The EU-US Privacy Shield Framework.

7. How can customers and website users defend themselves if they believe that VIOLA travel s.r.o. does not process their personal data in a lawful manner?

In this case, they can file an objection with VIOLA travel s.r.o. or/and have the right to file a complaint with the supervisory authority, which is the Office for Personal Data Protection.

8. What rights do customers and website users have against VIOLA travel s.r.o. as a personal data controller?

Customers and users of the website may at any time request VIOLA travel s.r.o. to

  • gave them access to their personal data
  • corrected their personal data which is not accurate
  • erase their personal data if the conditions set out in Article 17 of the GDPR are met, or restrict their processing.

9. What is the right of access to personal data?

Customers and website users can ask VIOLA travel s.r.o. to tell them whether it processes their personal data.

Customers and users of the website may request access to the personal data processed and information about the processing of such data.

Customers and users of the website may request VIOLA travel s.r.o. to provide a copy of the personal data processed.

10. Can customers and website users request access to personal information from someone other than themselves?

No, it’s not. Customers and website users can only request access to their personal data. If they want to ask someone else to exercise the right, they must have a power of attorney from that person.

11. How can customers and website users make this request?

They can make this request by any means, including email. However, the officer in charge has a duty to establish their identity and may ask them to provide proof of their identity.

12. By when will VIOLA travel s.r.o. provide an answer?

VIOLA travel s.r.o. will inform customers/users of the website about the measures taken, as a rule, within one month. However, in certain complex cases, it may extend the deadline.

13. How much does this application cost?

This request and its processing is free of charge. However, in justified cases, VIOLA travel s.r.o. may request reimbursement of certain costs (e.g. the cost of a portable disk on which a list of all personal data processed by VIOLA travel s.r.o. is provided).

14. How can a customer withdraw consent to the processing of personal data?

If the customer has given consent to the processing of personal data, usually consent to the taking of photographs, then they can withdraw this consent at any time. If website users do not wish to allow the storage of cookies, it is sufficient to adjust this setting in the browser. However, the withdrawal of consent shall not affect the lawfulness of the processing of personal data based on consent given before its withdrawal. This means that the processing of personal data is lawful until consent is withdrawn.
